2. The petitioner apprehends his arrest in connection with N.H. Bangra P.S. Case No. 109 of 2023 dated 04.08.2023, registered for the offences punishable under Sections 147, 148, 149, 341, 342, 323, 324, 325, 354, 427, 307, 333, 353, 114, 188 and 504 of the Indian Penal Code.

3. Allegedly, twenty-two named accused persons including the petitioner along with fifty to sixty unknown persons caused serious obstruction in discharge of the official's duty to the police personnel and other officers, who were engaged in removing the encroachment. It is also alleged that the accused persons including the petitioner damaged the JCB machine and misbehaved with the police officials by making a criminal

Learned Advocate appearing on behalf of the petitioner taking this Court through the FIR contended that except the petitioner is said to be member of the mob, there is no specific accusation of any overt act leading to injury to any of the person. Moreover, taking note of the aforesaid facts and omnibus nature of allegation, co-accused persons who were facing identical allegation have been accorded the privilege of anticipatory bail by a Bench of this Court vide Cr. Misc. No. 79896 of 2023 dated 14.05.2024. The case of the petitioner stands at similar footing is the contention of the learned Advocate. The petitioner bears fair antecedent and he undertakes that he will fully cooperate in the proceeding of the Court.

5. On the other hand, learned Advocate for the State vehemently opposed the pre-arrest bail application.

Regard being had to the submissions advanced by the learned Advocates for the respective parties and considering the accusation against the petitioner coupled with the fact that case of the petitioner is based on parity with those who have been accorded the privilege of anticipatory bail, let the petitioner, above-named, be released on bail, in the event of

No.85571 of 2025(2) dt.24-12-2025 3/3 his arrest or surrender before the Court below within a period of four weeks from the date of receipt / production of a copy of this order, upon furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Samsatipur in connection with N.H. Bangra P.S. Case No. 109 of 2023, subject to the conditions laid down in Section 482(2) of the B.N.S.S., 2023, with the further condition that one of the bailors shall be the own / close family members of the petitioner.
