JUSTICE ASHUTOSH KUMAR ORAL ORDER 07-10-2020 Heard Mr. Shambhu Nath Thakur learned counsel for the petitioner and Mr. Madanjeet Kumar for the informant. The State is represented by Mr. Ram Priya Sharan Singh.

The petitioner seeks bail in anticipation of his arrest in connection with Koilwar P.S. Case No. 236 of 2019 dated 11.07.2019 instituted for the offences under Sections 341, 323, 324, 325, 308, 504, 506 and 34 of the Indian Penal Code.

The occurrence appears to have arisen out of a small dispute when the informant was asked not to unload the bricks. The petitioner and others are said to have assaulted the informant and other members of the family of the informant but the injury suffered by most of them are reported to be simple in nature.

One of the persons who has received four injuries viz. Shanti Devi, three of such injuries have been sent for X-ray report. The last of the injury on her person has been reported to be simple.

Considering the circumstance under which the occurrence took place and the nature of accusation against the petitioner as well as taking into account the fact that one of the co-accused person of this case has already been granted anticipatory bail and that the petitioner is a person of clean antecedent, he is also directed to be released on bail, in the event of his arrest or surrender before the court below within a period of eight weeks from the date of receipt/production of a copy of this order, on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bhojpur at Ara in connection with Koilwar P.S. Case No. 236 of 2019, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Ashutosh Kumar, J) krishna/- U T
