2. The petitioner has approached this Court for the following reliefs:- "1. That this writ petition is being filed for issuance of an appropriate writ/ writs, order/ orders, direction/directions for payment of consequential benefits in the light of order dated 13.01.1997 by accepting the joining from 06.12.1997 as well as by quashing the order dated 02.12.2023 passed by respondent No. 6 whereby and whereunder the Appeal of petitioner has been dismissed on the ground of jurisdiction and for other necessary relief/reliefs on the

Patna High Court CWJC No.101 of 2024(6) dt.09-10-2025 2/2 basis of facts and circumstances of the case."

3. Learned Advocate for the petitioner submitted that identical issue has come up for consideration before this Court in C.W.J.C. No. 25071 of 2019, the copy of which is placed on Annexure P/17. It is the contention of the petitioner that if the present writ petition shall be disposed off in terms with the afore-noted order, the concerned respondent shall consider the same and pass an appropriate order. Though a counter affidavit has been filed on behalf of respondent no. 3 and the claim of the petitioner has been refuted.

4. Considering the limited grievance of the petitioner, the present writ petition stands disposed off with a liberty to the petitioner to approach before the respondent no. 3 by filing a fresh representation.

5. In case the claim of the petitioner finds favour and identical to those of the petitioners of C.W.J.C. No. 25071 of 2019, the identical relief be extended in favour of the petitioner.

6. In case the petitioner is non-suited, the representation of the petitioner must be disposed off by a reasoned and speaking order.

7. The writ petition stands disposed off.
