Petitioner is in custody in connection with Arer PS Case No. 148 of 2018 for the alleged offence under Sections 272 and 273 of the Indian Penal Code as also under Section 30(a) of the Bihar Prohibition and Excise Act. Learned counsel representing the petitioner submits that the petitioner is in custody since 19.11.2018. He further submits that the petitioner has no criminal antecedent and has been implicated in the instant case on mere suspicion. He also submits that nothing was recovered from the possession of the petitioner and he has no concern with the business of liquor or the place from where the liquor was seized.

Considering the totality of the facts and circumstances

Patna High Court Cr.Misc. No.79596 of 2018(2) dt.11-01-2019 2/2 of the case, let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Sessions Judge 2nd-cum-Special Judge, Excise Act, Madhubani/Incharge Successor Court in Arer PS Case No. 148 of 2018 on the condition that bailors should be elected representatives of the local body.
