The petitioner, who is in custody since 12.09.2019 seeks bail in connection with Pupri P.S. Case No. 396 of 2019 dated 12.09.2019 instituted for offence under Sections 414 and 34 of the Indian Penal Code and Section 25(1-b)a, 26 and 35 of the Arms Act.

On secret information to the Officer -in -charge of Pupri Police Station that some miscreants are planning to commit an offence, a raid was conducted and a vehicle was intercepted. Two persons tried to flee away but they were

Patna High Court CR. MISC. No.80254 of 2019(3) dt.04-06-2020 2/2 apprehended by the police. One of the apprehended persons disclosed his name as that of petitioner. From his possession, one loaded country made pistol and three live cartridges were recovered.

It has been urged on behalf of the petitioner that because of the bad antecedent report of the petitioner, the local police has made him accused in this case also. There has not been any recovery from the possession of the petitioner and what has been shown to be recovered from him, is only the imagination of local police. Regard being had to the afore-stated facts and the period of custody of the petitioner, he is directed to be released on bail on furnishing bail bonds of Rs. 10,000 (Rs. Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Pupri, Sitamarhi, in connection with Pupri P.S. Case No. 396 of 2019.
