2. The petitioner seeks regular bail in connection with Bagengola P.S. Case No.112 of 2020 (G.R. No.2569 of 2020), registered for the offences punishable under Sections 341, 323, 504, 506, 379, 307 and 34 of the Indian Penal Code.
3. As per the prosecution case, four accused persons including the petitioner assaulted the son of informant by means of lathi and rod consequently the son of informant fell down. In the mean time, Kanhaiya Yadav who was with the son of informant came back and having spotted by Kanhaiya Yadav and other villagers, the accused persons snatched the golden chain and some money and fled away.
4. Learned counsel for the petitioner submits that the
Patna High Court CR. MISC. No.86488 of 2023(2) dt.23-01-2024 2/2 petitioner is quite innocent and has been falsely implicated in this case on the basis of suspicion and due to village politics. He further submits that there is no specific overt act alleged against the petitioner. He also submits that informant is not an eye witness and the alleged occurrence took place on 24.09.2020, however, the F.I.R. has been lodged on 04.10.2020. Learned counsel submits that petitioner has got no criminal antecedent and he is in custody since 25.10.2023. He further submits that petitioner is a student.
5. Learned APP for the State has opposed the prayer for regular bail of the petitioner.

Considering the facts and circumstances of the case and the submissions of learned counsel for the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-I, Buxar in connection with Bagengola P.S. Case No.112 of 2020 (G.R. No.2569 of 2020). (Sunil Dutta Mishra, J) Ritik/- U T
