Petitioner seeks bail in Khagaria Mahila P.S. Case No. 26 of 2018 instituted for the offence under Section(s) 363, 366-A and 506 Indian Penal Code.

Counsel for the petitioner submits that Petitioner is said to be in custody since 30.08.2018 having clean antecedent. During course of investigation, victim has been examined under Section 164 Cr.P.C., wherein, she has not levelled any allegation of illegal act against the petitioner. She has levelled general and omnibus allegation that while she had gone to attend call of nature, she was taken on motorcycle by this petitioner and Neero Paswan. She was given milk to drink.

Patna High Court Cr.Misc. No.79203 of 2018(2) dt.24-01-2019 2/2 Thereafter, she became unconscious. She found herself in the house of Mausa of this petitioner. The petitioner put vermilion on her head. Thereafter, she was brought to her house by Ruby Devi, Raushni Devi etc. as mentioned in the written report. In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate 1st Class, Khagaria, in connection with Khagaria Mahila P.S. Case No. 26 of 2018, subject to the condition that both the bailors shall be close relative of the petitioner.
