The petitioner seeks bail in a case registered for the offence under Sections 365/34 of the Indian Penal Code.

Earlier the prayer for bail of the petitioner was refused vide order dated 11.09.2018 passed in Cr. Misc. No. 38800 of 2018.

Learned counsel appearing for the petitioner submits that the petitioner has clean antecedent. He has falsely been implicated in the present case only on the basis of suspicion. Vide order dated 12.12.2022, a report was called for with regard to the present status of the trial. Report of the

Patna High Court CR. MISC. No.4331 of 2020(7) dt.13-03-2023 2/2 learned Trial Court dated 20.12.2022 reveals that all the prosecution witnesses have been examined. Further submits that the part argument has been concluded and the case is fixed for final argument on 08.12.2022.

Learned A.P.P. for the State, on the other hand, has vehemently opposed the prayer for bail of the petitioner. In view of the report of the learned Trial Court, I am not inclined to enlarge the petitioner on bail. Prayer is refused.

However, the learned Trial Court is directed to expedite the trial.
