JUSTICE SHIVAJI PANDEY ORAL ORDER 06-11-2019 In this case, the petitioner is seeking anticipatory bail in connection with Rupaspur P.S. Case No.206 of 2016, registered for the offence punishable under Sections 323, 307, 315, 316, 406, 498(A), 120(B)/34 of the Indian Penal Code and under Section 3/4 of the Dowry Prohibition Act. Opposite party no.2 is physically present and submits that the petitioner is suffering from illness, so he is not present but, fairly states that they are living peacefully and now there is no dispute between them.

In such view of the matter, let the petitioner, namely, Amit Kumar, be released on anticipatory bail in the event of his arrest or surrender before the learned Court below

Patna High Court CR. MISC. No.4571 of 2019(10) dt.06-11-2019 2/2 within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) with two sureties of the like amount each to the satisfaction of the A.C.J.M.-II, Danapur, Patna, in connection with Rupaspur P.S. Case No. 206 of 2016, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure. However, the Trial Court is directed to take necessary step in the case looking to the situation that both the parties are living together peacefully and now there is no dispute between them.
