2. The petitioner has preferred this application for grant of regular bail in connection with Malahi P.S. Case No. 25 of 2024 dated 20.08.2024 registered for the offences punishable under Sections 126(2), 115(2), 118, 109, 352, 351(2) of B.N.S., 3(i)(r)(s) of SC/ST Act and 37 or Bihar Prohibition & Excise Act.

3. As per the prosecution case, the petitioner has snatched bicycle of the informant's husband. When called for return the bicycle, the petitioner came with a heavy sharp weapon and assaulted the informant's husband on his neck due to which he sustained grievous injury.

4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. Nothing has been recovered from the possession of the petitioner. It is further submitted that the injury sustained by the informant's husband is simple in nature. No public was present at the time of occurrence. The petitioner has no concern with the alleged occurrence. The petitioner has no criminal antecedent as stated in para 3 of the bail petition. The petitioner is in custody since 21.08.2024.

5. Learned A.P.P. for the State has opposed the bail petition of the petitioner.

6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Court No.1, East Champaran, Motihari in connection with Malahi P.S. Case No. 25 of 2024.

7. The application stands allowed.
