JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 15-10-2020 Heard learned counsel for the petitioner and the learned A.P.P. for the State through video conferencing. The petitioner apprehends his arrest in connection with Special Case No. 52 of 2018, arising out of Nawada Town P.S. Case No. 715 of 2018, registered under Section 384 of the Indian Penal Code and Section 2(xii) of Prevention of Corruption Act, 1988.

The accusation is that due to death of Dablu Lameti and Gopi Kumar, husband and nephew of Complainant Parwati Devi, who were drown in the well, the Complainant received information from the office of collector to receive compensation amount from the office of Disaster Management. Thereafter, Complainant approached in the said office, where petitioner being Data Entry Operator made demand of money as ransom and also talked to the Complainant on her mobile for that purpose and also given

Patna High Court CR. MISC. No.82059 of 2019(4) dt.15-10-2020 2/2 threatening that if the money will not be given, her legs and hands will be broken. Thereafter, on the basis of complaint of Parwati Devi to Collector, Nawada, present case was instituted.

Learned counsel appearing for the petitioner submits that it would appear from the F.I.R. that no any money was taken by the petitioner from the complainant Parwati Devi and only it has come that talk was made by the petitioner to the complainant. Further submission is that petitioner has already been removed from the office, which has come in paragraph 41 of the case diary. The petitioner has no criminal antecedent.

Having regard to the facts and circumstances of the case, let the above named petitioner, be released on bail, in the event of his arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Special Judge, Vigilance-1st, Patna in connection with Special Case No. 52 of 2018, arising out of Nawada Town P.S. Case No. 715 of 2018, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
