JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-01-2019 This application, for grant of anticipatory bail, arises out of Kesariya P.S. Case No. 155 of 2018, disclosing offences under Sections 304(B), 120(B), 34 of the Indian Penal Code. Petitioner happens to be brother in law (devar) of the deceased and allegation against him and others is of causing death of the deceased for demand of dowry.
Submission of learned counsel for the petitioner is that he is brother in law of the deceased and no specific allegation has been attributed to him and in this case whole family members have been made accused.
Heard learned A.P.P. also.
Having heard both sides, considering the submission, as above, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court
Patna High Court Cr.Misc. No.78850 of 2018(2) dt.11-01-2019 2/2 below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty five Thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate -XI, East Champaran at Motihari, in connection with Kesariya P.S.
