JUSTICE AJIT KUMAR ORAL ORDER 19-12-2025 The present application has been filed for modification of order dated 17.09.2025 passed in Cr. Misc. No. 67004 of 2025 whereby the petitioners have been granted the privilege of anticipatory bail with certain conditions.

2. Learned counsel for the petitioners seeks modification of the condition no. (ii) of order dated 17.09.2025 which directs the petitioners to appear on each and every date before the trial court and failure to do so for two consecutive dates without plausible reason will entail cancellation of their bail bond by the trial court itself. The modification is sought in view of the fact that petitioner, Md. Ajmat @ Md. Asmat @ Mohammad Ajmat is living at Dammam (Saudi Arabia) for his

No.87370 of 2025(2) dt.19-12-2025 2/2 livelihood and it may not possible for the petitioner to physically appear before the Trial Court on each and every date but submits that effective dates like framing of charge and on the dates, where the presence of this petitioner is necessary and is directed by the Trial Court, the petitioner would make himself available by ensuring his presence on such dates during course of the trial.

3. In view of the submission so made, the condition no.(ii) of order dated 17.09.2025 passed in Cr. Misc. No. 67004 of 2025 is modified by directing the trial court to address the same by passing appropriate order, taking cue from the dictum of the Hon'ble Apex Court rendered in the case of Satender Kumar Antil v. CBI & Anr as reported in (2022)10 SCC 51, on the application which would be filed by the petitioner seeking such indulgence.

4. Accordingly, the application for modification stands allowed to the aforesaid extent only.
