2. The petitioner seeks bail in connection with Mehsi P.S. Case No. 211 of 2023 registered for the offence under Sections 406, 420, 34 of the Indian Penal Code.

3. As per the prosecution case, the petitioner is said to have taken money for transfer of land and subsequently he has resiled from that statement.

4. It has been submitted by the learned counsel for the petitioner that the petitioner is in jail since 18.10.2023 and no offence is made out against the petitioner in view of the law laid down by the Hon'ble Supreme Court in the case of Murari Lal Gupta Vs. Gopi Singh reported in 2005 13 SCC 699.

5. Learned counsel for the informant and the learned APP for the State has opposed the application of the petitioner for grant of bail.

6. Considering the aforesaid facts and also in view of the law laid down by the Hon'ble Supreme Court in the case of Murari Lal Gupta Vs. Gopi Singh (supra), this application is allowed.

7. Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, First Class, East Champaran/concerned Court below in connection with Mehsi P.S. Case No. 211 of 2023.
