====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 28-02-2025 Heard learned counsel for the petitioners and learned A.P.P. for the State.

2. This petition has been filed for modification of order dated 19.9.2024, passed in Cr.Misc. No.58352/2024.

3. Learned counsel for the petitioners submits that the petitioner no.1 is vehicle owner, whereas petitioner no.2 is driver of the said vehicle and he is too poor to deposit Rs.1 lac in the Mining Department. Petitioners pray for a direction only to pay Rs. 1 lac each vehicle at the time of furnishing bail bond.

4. Since petitioners had undertaken to deposit a sum of Rs. 1 lac each in the Mining Department, Bhojpur at Ara, without admitting their guilt, at the time of consideration of

Patna High Court CR. MISC. No.88823 of 2024(2) dt.28-02-2025 2/2 their bail petition, plea of poverty of petitioners cannot be a ground for modification of deposit amount, as such, this modification petition is accordingly dismissed.

5. Let the petitioners surrender and furnish bail bonds within a period of further six weeks from today, by way of last indulgence.
