2. The petitioner is in custody in connection with Madhepura (Bharahi O.P.) P.S. Case No. 468 of 2022 for the offence punishable under sections 304(B), 302 and 34 of the Indian Penal Code, lodged on 21.05.2022 by the informant, Niro Devi.

3. As per the prosecution story, the daughter of the informant namely Guddi Kumari got married with Pradeep Rishideo and out of the said wedlock, two female children were born. The allegation is that she was being tortured for demand of dowry. On the fateful day, Guddi Kumari was killed by her in-laws and the husband and after receiving the information, the informant went to the house and found the dead-body and all the

4. Learned counsel for the petitioner submits that earlier, vide Cr. Misc. No. 60949 of 2024, his bail was rejected on 18.02.2025, the poisioning was ruled out as some injuries were found on the deceased person, he evaded arrest for sometime, in that background, the bail application was rejected.

5. Learned APP opposes the prayer for bail submitting that he being the husband, cannot exonerated all the responsibilities.

6. The allegation is there, the poisioning has been ruled out, two out of six witnesses have been examined, the petitioner is in custody since 07.12.2023, an undertaking has been given that he shall be diligently appearing in trial, the couple was blessed with the two female child and the mother is no more, in that background, this Court is inclined to extend him the privilege of bail.

7. Let the petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of like amount each to the satisfaction of learned Additional Sessions Judge 1st-cum-Special Judge, SC/ST, Madhepura, in connection with Madhepura (Bharahi O.P.) P.S. Case No. 468 of 2022 subject to the following conditions:

Patna High Court CR. MISC. No.85995 of 2025(2) dt.12-12-2025 3/3 (i) one of the bailor should be the family member/relative of the petitioner who shall provide official document to show his/her bona fide;

(ii) the petitioner shall appear on each and every date before the Trial Court and failure to do so for two consecutive dates without plausible reason will entail cancellation of his bail bond by the Trial Court itself;

(iii) the petitioner shall in no way try to induce or promise or threat the witnesses or tamper with the evidences, failing which the State shall be at liberty to take steps for cancellation of the bail bonds;

(iv) the petitioner shall desist from committing any criminal offence again, failing which the State shall be at liberty to take steps for cancellation of his bail bonds. (Rajiv Roy, J) vinayak/- U T
