In this case, the petitioners are seeking anticipatory bail in connection with Buxar (Industrial) P.S. Case No. 171 of 2018, registered for the offence punishable under Section 9/2 of the Bihar Prohibition and Excise Act, 2016.
A car was coming from the side of Uttar Pradesh State, the same was intercepted at the bridge and it was found that two persons was in intoxicated condition and they have given the name of the present petitioners to have fled away from the car.
There is no recovery of liquor either from the car or
Patna High Court Cr.Misc. No.79014 of 2018(2) dt.09-01-2019 2/2 from the person. Only the allegation has been made that the police has found the occupants to had taken the wine. Looking to the aforesaid facts, let the petitioners, namely, Suresh Singh Yadav and Rajesh Singh, be released on anticipatory bail in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand Only) each with two sureties of the like amount each to the satisfaction of the A.D.J.-II-cum- Special Judge, Excise, Buxar, in connection with Buxar (Industrial) P.S. Case no.171 of 2018, subject to the condition as laid down under Section 438(2) of the Code of Criminal Procedure.
