The petitioners apprehend their arrest in Obra P.S. Case No.159 of 2019 registered under Sections 366A and 34 of the Indian Penal Code.

The informant alleged that his daughter aged about 15 years was enticed away by Sudhir Paswan, Jaynandan Paswan(petitioner No.1) and Chinta Devi(petitioner No.2) on 28.05.2019 with intention to get her married. The learned counsel for the petitioners submits that petitioners have no manner of concern with the daughter of the informant or with Sudhir Paswan. Petitioners are co-villagers. The daughter of the informant has got love affairs with Sudhir Paswan and both of them fled away. They are living together.

No.84828 of 2019(4) dt.25-06-2020 2/2 The petitioners have been implicated in the case only because the informant earlier filed Title Suit No.20 of 2017(Annexure-2) in the Court of Munsif, Daudnagar, Aurangabad against Balrup Paswan. Balrup Paswan is the father of petitioner No.1 and the husband of petitioner No.2 that is why the petitioners have been implicated in the case.

Taking into consideration the fact that petitioners have got land dispute with the informant for which the informant has already filed title suit(Annexure-2) and petitioners are not at all related with the family affairs of Sudhir Paswan who is alleged to have enticed the daughter of the informant, let the petitioners, above named, in the event of their arrest or surrender before the court below within a period of four weeks from the date of receipt of the order, be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned S.D.J.M., Aurangabad in connection with Obra P.S. Case No.159 of 2019, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
