ANJANA MISHRA ORAL ORDER 04-12-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 09.09.2019 in connection with Pirpainti P.S. Case No.213 of 2019 registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.

Learned counsel for the petitioner submits that the petitioner is merely the Driver of the Magic vehicle and the alleged recoveries were also not from his conscious possession. It is further submitted that the petitioner has got no criminal antecedents.

Considering the aforementioned facts and circumstances and that the petitioner has no criminal antecedents, let the petitioner, above named, be released on bail

Patna High Court CR. MISC. No.79390 of 2019(2) dt.04-12-2019 2/2 on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Additional District & Sessions Judge Cum Special Judge, Excise, Bhagalpur, in connection with Pirpainti P.S. Case No.213 of 2019.
