The petitioner seeks bail in connection with Banka P.S. Case No.905 of 2019 registered for the offence under Sections 147, 149, 323, 307 of the Indian Penal Code and Sections 3⁄4 of Explosive Substance Act.

Allegation against the petitioner is to have hurled bomb on the roof of the informant's house with an intention to kill him along with other co-accused persons. 4.

Learned counsel appearing on behalf of the petitioner has submitted that petitioner has falsely been implicated in the present case. It is submitted that there is no specific allegation against the petitioner rather the allegation

Patna High Court CR. MISC. No.2734 of 2024(3) dt.20-03-2024 2/2 against this petitioner is general and omnibus in nature. It is also submitted that no one sustained injury in the alleged occurrence. It is also submitted that similarly situated co-accused persons have already been granted bail by different learned co-ordinate Bench of this Court through Cr. Misc. No.9978 of 2020 on 27.02.2020, Cr. Misc. No.27575 of 2020 on 27.02.2020, Cr. Misc. No.25026 of 2021 on 20.01.2022. It is further submitted that petitioner is in custody since 21.08.2023. 5.

Learned APP appearing for the State, opposes the prayer for bail of the petitioner. 6.

Considering the facts and circumstances and submissions made on behalf of the petitioner, let the petitioner, above named, is directed to be released on bail in connection with Banka P.S. Case No.905 of 2019 on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Banka/concerned court, Banka.
