In this case, the petitioners are seeking anticipatory bail in connection with Sri Nagar (Pujaha) P.S. Case No. 85 of 2018, registered for the offence under Sections 341, 323, 324, 307, 379 and 504/34 of the Indian Penal Code. The informant is running a tea shop. Allegation has been made that the accused persons had gone to his shop and asked the informant to give tea. After taking tea, they started leaving, whereupon the informant demanded the money, but instead of paying the money the accused persons abused and assaulted the informant.

Looking to the nature of allegation, this Court is

Patna High Court Cr.Misc. No.29 of 2019(2) dt.28-01-2019 2/2 not inclined to grant bail to the petitioners. Accordingly, the prayer for bail is rejected. However, if the petitioners surrender before the Court below within three weeks from today and pray for regular bail, the Court below will consider the same and pass appropriate order on the same day without being influenced by the order of this Court.
