The petitioner seeks regular bail in connection with Dehri (Town) P.S.Case No.555 of 2019 dated 15.8.2019 registered for offences punishable under Sections 30(a) of the Bihar Prohibition and Excise (Amendment) Act, 2018 . Allegation against the petitioner is about recovery of 1080 ltrs. of liquor from the pick-up van, petitioner was arrested at the spot and he is said to be driver of the vehicle. Submission of the learned counsel for the petitioner is that he is neither owner of the vehicle nor he has any concern with the seized liquor. He is in custody for 3 1⁄2 months as well as the charge-sheet has been submitted in this case, as such there is no chance of tampering with the evidence..

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned 2nd Addl. Sessions Judge cum Special Judge, Excise, Rohtas at Sasaram in connection with Dehri (Town) P.S.case No.555 of 2019 dated 15.8.2019 with condition to co-operate in the disposal of the trial. With the aforesaid observation, this application is allowed.
