The petitioner is in custody in connection with Saharsa Sadar P.S. Case No. 717 of 2018 for the offences under Sections 147, 148, 149, 341, 323, 307, 302, 506 of the Indian Penal Code and Section 27 of Arms Act.

Learned counsel for the petitioner submits that the petitioner has no criminal history and he is in custody since 20.06.2018. He further submits that in the prosecution case there is no allegation against this petitioner in the commission of crime. The brother of the informant was shot dead by Babu Sharma as evident from the prosecution case.

Considering the aforesaid, the Court is inclined to

Patna High Court Cr.Misc. No.79672 of 2018(2) dt.15-01-2019 2/2 grant bail to the petitioner, let the petitioner be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saharsa in connection with Saharsa Sadar P.S. Case No. 717 of 2018.
