2. The petitioner apprehends his arrest in a case registered for the offence under Section 160(2), 154 of Railway Act.
3. Allegation against petitioner is that when gate man was closing the gate barrier with hooter sound at railway track gate no. 31C/T between Kajra and Uren station, then this petitioner came on Toto vehicle having registration no. BR53/ER2702 and dashed Toto with gate barrier boom and fled away with Toto.
4. Learned counsel for the petitioner submits that petitioner has been falsely implicated in this case only on
Patna High Court CR. MISC. No.1622 of 2025(2) dt.11-02-2025 2/2 suspicion. Petitioner has got no concern with the Toto. He is neither owner nor driver of the said Toto. Petitioner claims clean antecedent.
5. Learned A.P.P. for the State has opposed the prayer for anticipatory bail.
6. Considering the aforesaid facts and circumstances, in the event of arrest/surrender before the Court below within a period of eight weeks from today, let the above named petitioner be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Railway Judicial Magistrate, Lakhisarai in connection with RPF/POST/JMP Case No.600 of 2024, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
