JUSTICE BIBEK CHAUDHURI ORAL ORDER 28-06-2024 The petitioner is a superannuated as assistant (GradeIII) employee under Bihar Food and Civil Supplies Corporation, Patna. At the time of his superannuation on 31st January 2011, he was posted at the Corporation office at Gaya. The petitioner has approached this Court under Article 226 of the Constitution for redressal of his grievance due to non-payment of 6th Revised Pay Scale with effect from 01st April 2007.

2. The learned Advocate appearing on behalf of the petitioner refers to the Annexure P3 being an order passed by

Patna High Court CWJC No.816 of 2024(2) dt.28-06-2024 2/2 the Bihar Food and Civil Supplies Corporation liimited on 23rd September 2020, stating, inter alia, that the Corporation in its 163rd meeting dated 17th September 2022 held that the employees of the Corporation would get 6th Revised Pay Scale like that of employees of Food Supplies Corporation from 01st April 2007.

3. The learned Advocate appearing on behalf of the Corporation had not refuted the authenticity of the aforesaid order dated 23rd September 2020.

4. In view of such circumstances, the petitioner is obviously, entitled to get 6th Revised Pay Scale from 01st April 2007 to 31st January 2011. The respondents no. 02-04 are directed to make payment of arrears salary as per 6th Revised Pay Scale to the petitioner from 01st April 2007 till the date of his superannuation, if not already paid to him within 60 days from the date of this order.
