The petitioner seeks regular bail in connection with Barauni P.S. Case No. 310 of 2019 for the offence registered under Sections 25(1-B)a/26 and 35 of the Arms Act. The allegation is regarding the Police having apprehended two miscreants, one of them being the petitioner herein, and upon search, as far as the petitioner is concerned, one country made pistol and one live cartridge is stated to have been recovered.

The learned counsel for the petitioner submits that the petitioner is innocent, has been falsely implicated in the present case on account of previous three criminal cases being there as against the petitioner herein, in which the petitioner is

Patna High Court CR. MISC. No.83800 of 2019(3) dt.18-03-2020 2/2 on bail. It is further submitted that the petitioner is languishing in custody since 21.07.2019.

Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner as also taking into account the period of incarceration of the petitioner herein, I deem it fit and proper to direct for release of the petitioner herein on regular bail. Accordingly, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Baraurni P.S.
