The petitioners apprehend their arrest in Rosera P.S. Case No.237 of 2018 registered under Sections 385, 387, 504, 506 and 34 of the Indian Penal Code.
The petitioner is not named in the F.I.R. The name of petitioner transpired in the confessional statement of Anil Sahani. The mobile no.9776448428 stands in the name of father of Anil Sahani and Anil Sahani was using that mobile. Learned counsel for the petitioners submitted that Anil Sahani is said to have confessed his guilt and disclosed that the petitioners are his accomplices but save and except the confession of Anil Sahani, the Investigating Officer did not
Patna High Court Cr.Misc. No.79264 of 2018(2) dt.28-01-2019 2/2 collect any further tangible material to show that the petitioners from mobile of Anil Sahani ever called the informant and demanded any extortion.
Having considered the facts aforesaid, the above named petitioners, in the event of their arrest or surrender before the learned court below within a period of four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Rosera, Samastipur in connection with Rosera P.S. Case No.237 of 2018, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
