2. At the very outset, learned counsel for the petitioner has submitted that the petitioner has been given the benefit of Section 41(1) of the Cr.P.C.

3. It appears itself that there is no occasion of petitioner's arrest. Hence, if the petitioner surrenders before the court below, the court below shall pass order on its own merit without being prejudiced by this order.
