JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-01-2019 Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 30(a) of Bihar Prohibition and Excise Act, 2016 and Sections 25(1-b)a/26 of the Arms Act.

The name of this petitioner is said to have disclosed by co-accused Johnson Rai and after that petitioner was arrested and confessed his guilt leading to recovery of near about 60 litres Mahua liquor from a brick-kiln.

Submission on behalf of the petitioner is that nothing has been recovered from the conscious possession of the petitioner and so far as alleged disclosure of the petitioner is

Patna High Court Cr.Misc. No.198 of 2019(2) dt.17-01-2019 2/2 concerned as the same is nothing but only the high handedness of the police. It is also pointed out by him that, moreover, one co-accused, namely, vikky Kumar has already been granted privilege of bail by a co-ordinate Bench of this Court. Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna in connection with Chowk P.S.
