Petitioners, who are in custody, seek bail in a case registered for the offences punishable under Sections 414 of the Indian Penal Code and Section 139 of Bihar electricity Act, 2003.
Allegation is recovery of stolen aluminum wire from a pick up van in which petitioner was sitting. It has been submitted on behalf of the petitioner he is innocent and has committed no offence. He has been falsely implicated in this case. Petitioner was a passenger of the said vehicle. Petitioner has no criminal antecedent and is in custody since 08.09.2019. Similarly placed co-accused has been granted bail by co-ordinate bench of this court vide order dated
Patna High Court CR. MISC. No.85394 of 2019(2) dt.07-01-2020 2/2 20.12.2019 passed in Cr. Misc. No. 84727 of 2019. Considering the aforesaid facts and circumstances of the case, let the petitioners named above be released on bail upon furnishing bail bonds of Rs. 20,000/- (twenty thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Mahua P.S. Case No. 515 of 2019, subject to conditions:
(1) Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.
(2) Petitioner shall co-operate in the trial and shall be represented on each and every date fixed by the court.
(3) If the petitioner tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioner.
