2. The petitioner seeks bail in a case registered for the offence punishable under Sections 363, 365, 504 and 34 of the Indian Penal Code.
3. The prosecution case, in brief, is that on 06.06.2023 at about 5 AM, daughter of informant had gone to attend the call of nature but she did not return. Informant suspects that all the F.I.R. named accused persons, including this petitioner, kidnapped his daughter.
4. It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has committed no offence.

During investigation it has come that the mobile number mentioned in the F.I.R. does not belong to this petitioner. The present F.I.R. has been lodged after inordinate delay of one month from the date of alleged occurrence and there is no plausible explanation for the same. It is further submitted that during trial, three witnesses, including the informant, were examined and cross-examined and none of the witnesses have supported the prosecution case. The informant in his cross examination has categorically stated that this petitioner was no involved in the alleged occurrence. Charge-sheet has already been submitted that the petitioner is in custody since 10.05.2024. Petitioner claims clean antecedents.
5. On the other hand, learned A.P.P. for the State and learned counsel appearing on behalf of the informant have vehemently opposed the prayer for grant of bail to the petitioner.
6. Considering the aforesaid facts and circumstances of the case, rival submissions, nature of accusation, period of custody and clean antecedents of the petitioner, the prayer for grant bail of to the petitioner is allowed.
7. Accordingly, let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten
