JUSTICE VINOD KUMAR SINHA ORAL ORDER 23-01-2020 This is an application for grant of anticipatory bail in connection with Bihta P. S. Case No. 438 of 2015 disclosing offences under Sections 406, 420, 467, 468, 471, 120B of IPC. As per prosecution case, there was defalcation of crores of rupees by several PACS by using the revenue receipts, which was forged and same was deducted in the audit. Petitioner is also a Chairman of one of the PACS.

Submission of the learned counsel for the petitioner is that no specific allegation has been attributed against him and moreover, one Rambha Devi, whose prayer for anticipatory bail was also rejected by the learned Additional Sessions Judge by the common impugned order, has already been granted privilege of anticipatory bail by a Co-ordinate Bench of this Court after considering the materials, vide order dated 06.12.2019 passed in

Patna High Court CR. MISC. No.86595 of 2019(2) dt.23-01-2020 2/2 Criminal Misc. No. 80376 of 2019.

Having heard both sides, considering the above submissions, this application is allowed. Let the petitioner, above named, in the event of his arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Twenty Five Thousand) with two sureties of the like amount to the satisfaction of learned A.C.J.M., Danapur, Patna, in connection with Bihta P. S. Case No. 438 of 2015 with condition that he has to appear before the I.O. and co-operate in the investigation, otherwise, prosecution is at liberty to move for cancellation of his bail bonds.
