JUSTICE VINOD KUMAR SINHA ORAL ORDER 05-02-2020 Petitioner seeks regular bail in connection with Benipatti P.S. Case No. 72 of 2016 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 325, 427, 302 of IPC.

Earlier prayer for bail of the petitioner was rejected vide order dated 04.12.2018 passed in Criminal Misc. No. 60750 of 2018. Petitioner is said to have assaulted the informant by iron rod, causing injury, which succumbed to the death. Submission of the learned counsel for the petitioner is that he is in custody since 15.11.2017 and there is no substantive progress in the trial.

Heard learned A.P.P. also.

Having heard both sides, in view of the submissions, made above, I am not inclined to grant bail to the petitioner at

Patna High Court CR. MISC. No.80799 of 2019(2) dt.05-02-2020 2/2 this stage. However, the trial court is directed to expedite the trial and conduct it on regular basis.

At the same time, S.P., Madhubani is directed to ensure the presence of witnesses on the date fixed. With the above observations, this application is dismissed.
