2. The petitioner seeks regular bail in connection with S.Trial No. 867 of 2023 arising out of Motihari Town P.S. Case No. 981 of 2022 registered on 25.12.2022 lodged under Sections 395 of the I.P.C which was earlier rejected vide order dated 19.10.2023 passed in Cr.Misc. No. 68469 of 2023 with liberty that he may renew his bail after framing of charge.

3. Counsel further submits that petitioner is in custody since 06.03.2023 and charge has been framed on 06.11.2023 and upon perusal of records, it transpires that no witness has appeared for examination.

4. Learned counsel for the State opposes to prayer for

Patna High Court CR. MISC. No.86262 of 2023(3) dt.23-02-2024 2/2 bail.

5. In the present facts and circumstances of this case and the submissions made above, let the petitioner above named, be granted bail after framing of charge and on furnishing bail bonds of Rs.30,000/- (Rupees Thirty thousand) with two sureties of the like amount each to the satisfaction of learned ADJ-21th in connection with S.Trial No. 867 of 2023 arising out of Motihari Town P.S. Case No. 981 of 2022 , subject to the conditions laid down under Section 437 (3) of the Cr.P.C.
