Petitioner seeks bail in Kalyanpur P.S. Case No. 173 of 2018 (G.R. Case No. 5529 of 2018) registered for the offence punishable under Sections 413, 414, 419, 420, 465, 468 and 471/34 of the Indian Penal Code.
Informant is a police officer who has stated in his written complaint that on receipt of confidential information he raided the house of petitioner and found one blue colour Swaraj Tractor and one white colour Bolero Pickup van outside the door of petitioner without registration number and on demand brother of petitioner produced two smart cards, however, same on verification was found to be forged.
It has been submitted on behalf of the petitioner that
Patna High Court Cr.Misc. No.80181 of 2018(5) dt.21-02-2019 2/3 the said vehicles were purchased through financial company and petitioner had no knowledge that same were stolen vehicles. Petitioner has got no criminal antecedent and is in custody since 20.09.2018.
Considering the aforesaid facts and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, East Champaran at Motihari, in connection with Kalyanpur P.S. Case No. 173 of 2018 (G.R. Case No. 5529 of 2018), with following conditions:- (1)Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned.
(2) Petitioner shall co-operate in the trial and shall be properly represented on each and every date fixed by the court and shall remain physically present as directed by the Court and his absence on two consecutive dates without sufficient reason, his bail bond shall be cancelled by the court below.
(3) If the petitioner tampers with the evidence or the witnesses of the case, in that case,
Patna High Court Cr.Misc. No.80181 of 2018(5) dt.21-02-2019 3/3 prosecution will be at liberty to move for cancellation of bail of the petitioner.
