JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-03-2019 The petitioner apprehends his arrest in connection with Mahua P.S.Case No. 112 of 2018 registered under Sections 414/34 of the Indian penal Code and 25(1-B)a/26/35 of the Arms Act.

Allegation as per FIR is that police raided the place of occurrence during investigation of a case and arrested two accused persons and there is recovery of pistol and cartridges from them and they disclosed the name of the petitioner. Submission of learned counsel for the petitioner is that petitioner has no criminal antecedent and para 4 and 9 of the case diary disclose that witnesses have also not named this petitioner.

Having heard both sides and in the facts and

Patna High Court CR. MISC. No.877 of 2019(4) dt.25-03-2019 2/2 circumstances, as stated above, let the petitioner, abovenamed, in the event of arrest or surrender before the court below within a period of six weeks from the date of receipt of a copy of this order, be released on bail upon furnishing bail bond of Rs. 25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Smt. Hina Mustafa, J.M. 1st Class, Hajipur in connection with Mahua P.S. Case No. 112 of 2018; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
