2. In this case, the petitioner is seeking regular bail in connection with N.T.P.C. P.S. Case No. 35 of 2024 registered for the offences punishable under Sections 319(2), 318(4), 338, 336(3) and 340(2) of the Bharatiya Nyaya Sanhita.

3. Allegation against the petitioner is that he came at CISF Unit KSHTPP Kahalgaon Recruitment Centre to appear in the PST/PET examination for the post of constable/G.D.-2024. Further as per the guideline the verification of the real candidate is done through bio-metric process and its mapping/tally with photo Id/ admit card issued by the Staff Selection Commission whereas the LTI and the Photo of the candidate not tallied with the bio-metric taken in the written examination held on 24-022024 which created a doubt with regard to his impersonation while appearing for PST/PET. Besides this, on query regarding the identification of this petitioner, he admitted that his

Patna High Court CR. MISC. No.88738 of 2024(2) dt.05-02-2025 2/2 photograph is not tallying with the photo taken in the written examination on 24-02-2024 through bio-metric. He further admitted that an another person appeared in the written examination held on 24-02-2024 in place of petitioner.

4. The learned Counsel for the petitioner has submitted that he is innocent and has falsely been implicated in this case. The petitioner is in custody since 17.10.2024 and he is a person of clean antecedent.

5. On the other hand, the learned APP for the State opposed the prayer for bail.

6. Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned A.C.J.M.-VII, Bhagalpur in connection with N.T.P.C. P.S. Case No. 35 of 2024, subject to the following condition that the petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.
