2. This application is filed for modification of the order dated 23.02.2024 passed in Cr. Appeal (SJ) No. 3208 of 2023.

3. Learned counsel appearing on behalf of the appellant has submitted that the appellant was granted anticipatory bail on 23.02.2024 passed in Cr. Appeal (SJ) No. 3208 of 2023 with a direction to the appellant to surrender before the Court below within six weeks from today, the appellant be enlarged on anticipatory bail on furnishing bail bond of Rs. 20,000/- (Rupees Twenty thousand) with two

No.88529 of 2024(2) dt.17-01-2025 2/2 sureties of the like amount each to the satisfaction of learned Additional District Judge-3-cum- Exclusive Special Judge, SC/ST (PoA) Act, Darbhanga in connection with A.B.P. No. 28/2023 arising out of Biraul P.S. Case No. 480 of 2022, but due to some unavoidable circumstances, the appellant could not surrender and furnish the bail bond before the Court below within the stipulated time.

4. Learned counsel for the appellant seeks permission to extend the time for furnishing the bail bond of the appellant.

5. In view of the matter, let the time to surrender of the appellant, as ordered on 23.02.2024 passed in Cr. Appeal (SJ) No. 3208 of 2023 be further extended by four weeks from the date of receipt of this order.

6. Accordingly, the modification application is allowed and the order dated 23.02.2024 passed in Cr. Appeal (SJ) No. 3208 of 2023 is modified to the above extent. (Chandra Prakash Singh, J) Gautam/- U T
