The petitioner seeks bail in connection with Sare P.S. Case No. 196 of 2023 instituted for the offence under Sections 302, 201, 120(B) & 34 of the Indian Penal Code. 3.

Prosecution case in short is that on 30-10-2023, choukidar was informed by villagers about a woman's dead body lying in the eastern side of the village. The S.H.O. of Sare Police Station reached the spot, found the body covered with a bloodstained dupatta, and observed a deep neck cut likely caused by a blade found nearby. The woman appeared to be married, and her identity remained unknown 4.

It has been submitted on behalf of the petitioner

Patna High Court CR. MISC. No.90124 of 2024(4) dt.10-04-2025 2/3 that the petitioner is in custody since 21-07-2024. Petitioner bears no criminal antecedent/s, as per disclosure made in paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. Petitioner is not named in the FIR. Name of the petitioner has transpired during course of investigation. Nothing incriminating has been recovered from the possession of the petitioner. Postmortem was conducted but final opinion was reserved awaiting viscera report.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. It is submitted that petitioner has confessed his guilt in his confessional statement and has confessed that he performed marriage with deceased and later on, he slitted the throat of the deceased by means of blade, which was found near the dead body. Postmortem report also corroborates the allegation levelled in the FIR.

Considering the aforesaid facts and circumstances of the case, there being direct allegation against the petitioner which is confessed by the petitioner in his confessional statement, this Court, at this stage, is not inclined to grant bail to

However, petitioner will be at liberty to renew his prayer for bail if the trial is not concluded within a period of six months.
