The petitioner who is in custody since 25.08.2019 has filed the instant application for grant of bail in connection with Sheohar P.S. Case No. 192 of 2019 (District-Sheohar) registered for the offence punishable under section 392 of the Indian Penal Code.

As per the allegation in the FIR, three persons on the motorcycle are said to have looted the informant on the point of pistol and dispossessed him of his valuables including money, mobile phone etc.

It is submitted by learned counsel for the petitioner that the name of the petitioner has transpired on the confessional statement of one Manish Kumar. There is delay in lodging of the

No.79566 of 2019(2) dt.11-12-2019 2/2 F.I.R. in so far as the occurrence took place on 17.8.2019 at 4 p.m., the F.I.R. was lodged on 18.8.2019 at 10 a.m. No incriminating article has been recovered from the possession of the petitioner and the mobile phone said to have recovered belongs to the petitioner. The petitioner is in custody since 25.8.2019 and has no criminal criminal antecedent. The application for bail was opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the facts and circumstances of the case, let the petitioner above named be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sheohar in connection with Sheohar P.S.
