The petitioner is in custody in connection with Govindganj (Areraj O.P.) P.S. Case No. 274 of 2018, G.R. case No. 6712 of 2018, registered for the offence under Sections 420, 467, 468, 471, 34 of the Indian Penal Code.

Learned counsel for the petitioner submits that petitioner has no criminal antecedent. Referring to the prosecution case he submits that from perusal of the fardbeyan it would be evident that one Sahabuddin Ansari who taking advantage of lack of knowledge of informant how to withdraw the amount from ATM transferred Rs.40,000/- in his account through ATM of informant. The name of the petitioner figured

Patna High Court Cr.Misc. No.79656 of 2018(2) dt.15-01-2019 2/2 in the instant case only on the suspicion and he is in custody in this case since 01.10.2018.

Considering the fact that petitioner has no criminal antecedent and the admitted transaction from ATM of the informant by one Sahabuddin Ansari not by the petitioner, let the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Learned Chief Judicial Magistrate, East Champaran, Motihari in connection with Govindganj (Areraj O.P.) Police Station Case No. 274 of 2018, G.R. Case No. 6712 of 2018.
