The petitioner seeks bail in a case registered for the offence punishable under Sections 341, 342, 370, 376, 120(B) of the Indian Penal Code and Sections 3, 4, 5, 6, 7 of Immoral Traffic Act & Section 4 of POCSO Act.

Eight female named accused persons including the petitioner and two male were apprehended in objectionable position during course of raid and victim Pinki Khatoon has stated about the involvement of the petitioner in the activity of prostitution.

It is submitted by learned counsel for the petitioner that the petitioner has no concern with the aforesaid occurrence. She has been falsely implicated in this case at the instance of her

Patna High Court CR. MISC. No.83085 of 2019(2) dt.16-12-2019 2/2 enemy. She was maid in the house of Md. Chand and was apprehended from the said house during course of raid. She is not indulged in any business of flesh trade. She was also not found in objectionable position at the time of occurrence. She has no criminal antecedent and has been languishing in custody since 19.10.2019.

Learned APP for the State opposed the bail petition.

Considering the facts aforesaid, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned 1st Additional Sessions Judge-cum-Special Judge, Kishanganj in connection with Kishanganj Mahila P.S.
