JUSTICE VINOD KUMAR SINHA ORAL ORDER 25-03-2019 This application, for grant of anticipatory bail, arises out of Banka P.S. Case No. 625 of 2017, disclosing offences under Sections 366(A)/34 of the Indian Penal Code. Allegation against the petitioner is that he along with one Bablu Yadav and others kidnapped the minor daughter of the informant.

It appears that vide order dated 28.01.2019, a coordinate Bench of this Court has called for the upto date case diary as well as the statement of the victim under Section 164 Cr.P.C. and the petitioner was granted the privilege of provisional bail.

Submission of learned counsel for the petitioner is that he has falsely been roped in this case, which will appear from the F.I.R itself that the main allegation is against one Bablu

Patna High Court CR. MISC. No.481 of 2019(3) dt.25-03-2019 2/2 Yadav and furthermore the girl in her statement, recorded under Section 164 Cr.P.C., has not named the petitioner. Heard learned A.P.P. also.

Having heard both sides, in view of the above facts, this application is allowed. The provisional bail earlier granted to the petitioner vide order 28.01.2019, in connection with Banka P.S. Case No. 625 of 2017, is confirmed with the terms and condition mentioned in the order dated 28.01.2019. (Vinod Kumar Sinha, J) sunilkumar/- U T
