2. The petitioner apprehends his arrest in a case registered under Sections 126(2), 127(2), 115(2), 118(1), 109, 303(2), 308(3), 352, 351(2), 3(5) Bharatiya Nyaya Sanhita.
3. As per prosecution case, on the alleged date and time of occurrence, all the accused persons including this petitioner armed with pistol, lathi and sword assaulted informant and also snatched gold chain worth Rs. 2 lacs and Rs. 1.5 lacs cash from informant.
4. Learned counsel appearing on behalf of the petitioner submits that petitioner is innocent and has falsely been implicated in the present case due to patidari grudge. Further submission is that both parties are co-villagers and due to petty
Patna High Court CR. MISC. No.168 of 2025(2) dt.04-02-2025 2/2 dispute between them, a free-fight took place in which both sides sustained injuries. Case and counter case. Injuries sustained by informant are simple in nature. Similarly situated co-accused Ravi Shankar Rai has already been granted bail by this Court vide order dated 20.01.2025 passed in Cr. Misc. No. 89013 of 2024. Petitioner has got clean antecedent.
5. Learned A.P.P. for the State opposed the prayer for bail of the petitioner.
6. Having considered the fact that similarly situated co-accused has already been granted bail, nature of injury and clean antecedent, let the above named petitioner be released on bail, in the event of arrest or surrender before the learned court below within a period of eight weeks from today, on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Vaishali at Hajipur, in connection with Hajipur Sadar P. S. Case No. 673 of 2024, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Prabhat Kumar Singh, J) utkarsh/- U T
