2. The present criminal miscellaneous application has been filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as 'the BNSS, 2023') for grant of anticipatory bail to the petitioner who apprehends arrest in connection with Darauli P.S. Case No. 193 of 2024, lodged on 20.06.2024, under Sections 363/366 of the Indian Penal Code. Later on offences under Sections 4/8 of the POCSO Act have been added.

3. As per the prosecution, FIR has been lodged against four named accused persons including the present petitioner

Patna High Court CR. MISC. No.1035 of 2025(3) dt.08-05-2025 2/3 with allegation that petitioner has enticed away the daughter of the informant and there is direct involvement of the petitioner in the said occurrence.

4. Learned Counsel for the petitioner submits that the petitioner is innocent and has committed no offence. Counsel submits that on the previous occasion case-diary and statement of the victim under Section 164 Cr.P.C. were called for as the victim has been recovered. Statement of the victim under Section 164 Cr.P.C. has been received. Upon bare reading of the statement of the victim, it transpires that the victim and the petitioner went together with consent of each other and subsequently she returned. The victim has not alleged anything against the petitioner. Counsel for the petitioner submits that antecedent of the petitioner is clean.

5. Learned APP for the State opposes the prayer for bail of the petitioner.

6. As such, in the present facts and circumstances of this case, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 4 weeks from today, on furnishing bail bond of Rs.30,000/- (Rupees Thirty Thousand) as mentioned in Section 2(1)(d) of the BNSS, 2023 to the
