2. The petitioner has preferred this application for grant of regular bail in connection with Maner P.S. Case No. 224 of 2023, registered for the offences punishable under Section 304B/34 of the Indian Penal Code.
3. As per the prosecution case, the petitioner along with other co-accused persons are alleged to have killed the daughter of the informant for non-fulfillment of demand of Rs. 2,00,000/- as dowry.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in this case. The petitioner has got no criminal antecedent as stated
Patna High Court CR. MISC. No.1433 of 2024(4) dt.10-04-2024 2/2 in para 3 of the bail petition. The petitioner has no concern with the alleged occurrence. The petitioner has never demanded any dowry. The petitioner is in judicial custody since 06.07.2023.
5. Learned A.P.P. for the State has opposed the bail petition of the petitioner and submitted that the petitioner was indulged in killing the daughter of the informant. The petitioner is the husband of the deceased who used to torture the deceased.
6. Considering the aforesaid facts and circumstances of the case as well as the heinous nature of allegation against the petitioner, I am not inclined to enlarge the petitioner on bail.
7. Accordingly, the prayer for bail petition of the petitioner stands rejected.
8. The learned trial court is directed to expedite the trial and conclude the same at the earliest.
