JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-02-2019 Petitioner seeks bail in anticipation of his arrest in connection with Barauni (Garhara O.P.) P.S. Case No. 485 of 2018 registered for the offences punishable under Sections 341, 323, 307/34 and 120B of the Indian Penal Code, including Sections 25(1-B)(a), 26, 27, 35 of the Arms Act. Allegation against the accused persons, including the petitioner is of firing on the informant and causing injuries to him.
Submission of learned counsel for the petitioner is that during investigation it has come that he was not present there.
Heard learned APP and learned counsel for the informant. They have opposed the prayer for anticipatory bail on the ground that there is specific allegation of firing against

Having heard both sides and in the facts and circumstances, I am not inclined to grant privilege of anticipatory bail to the petitioner. However, if the petitioner surrenders and makes prayer for regular bail, the same shall be considered on the basis of materials collected during investigation and, if possible, to be disposed of on the same day. With the above observation, this application is dismissed.
