1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of regular bail in connection with Suiya P.S. Case no.118 of 2023 registered under sections 302 and 120B of the Indian Penal Code and section 27 of the Arms Act.

3. As per the prosecution case, the informant states that she saw Azad Ansari and Md. Dilshad open fire on her husband as a result of which he died. She further states that four other accused persons including the petitioner herein because of previous land dispute, are involved in the killing of her husband.

4. It is submitted by learned counsel for the petitioner that the petitioner has been falsely implicated in the case because of land dispute between the parties which would be evident from the FIR itself. On perusal of the FIR it would

Patna High Court CR. MISC. No.6639 of 2024(2) dt.17-02-2024 2/2 transpire that specific allegation is against Azad Ansari and Md. Dilshad and not the petitioner. The petitioner is in custody since 2.9.2023 and chargesheet has been submitted in the case.

6. Having heard learned counsel for the parties and taking into consideration the specific allegation in the F.I.R. being against Azad Ansari and Md. Dilshad and not the petitioner herein, the petitioner having remained in in custody since 2.9.20223 and chargesheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Suiya P.S. Case no. 118 of 2023 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Banka.
