Mr.Arun Kumar Pandey ====================================================== CORAM: HONOURABLE MR. JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 14-05-2019 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Marhowra P.S. Case No.437 of 2018 registered under Sections 363 and 366 of the Indian Penal Code. The accusation is of kidnapping the minor daughter of the informant by four persons including the petitioners, when she had gone to attend the call of nature.

Learned counsel for the petitioners submits that in her statement recorded under Section 164 of the Code of Criminal Procedure on 01.10.2018, the daughter of the informant has stated that she was kidnapped by the co-accused Abhishek and

Patna High Court CR. MISC. No.8922 of 2019(4) dt.14-05-2019 2/2 his father Shobhnarayan Giri. She has not stated any word against the petitioners. The petitioners have no criminal antecedents.

Having considered the facts and the circumstances of the case, let the petitioners, above named, in the event of their arrest or surrender by them within six weeks from today, be enlarged on bail on their furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate-VIII, Saran at Chapra, in connection with Marhawrah P.S. Case No.437 of 2018, subject to the conditions laid down under Section 438(2) Cr.P.C.
