JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 17-01-2019 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 272, 273, 34 of the Indian Penal Code and 30(a) of Bihar Prohibition and Excise Act, 2016.

Some persons were caught with Indian made foreign liquor and they disclosed that they used to purchase the Indian made foreign liquor from petitioner and others. Subsequently, the house of the petitioner was raided and searched and several bottles containing near about 14 litres Indian made foreign liquor were recovered from the house of the petitioner. Petitioner is in jail custody since 17.10.2018 and does not have

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge -3 cum Special Judge, Excise Act, Samastipur in connection with Bhibhutipur P.S. Case No. 288 of 2018.
